We must indicate that the Political Constitution of Peru of 1993 constitutes the juridical consecration of any juridical program and is the fundamental piece in the establishment of the juridical classification of the Nation. Being this like that to initiate the following investigation we have initiated with the knowledge of the Magna Carta, which assures the stability, rationalization and limitation us to the power of the authority, expressing it didactically for an agile and versatile reading of the own text, which final aim is to understand clearly what is the autonomy in the university system. ; Debemos indicar que la Constitución Política del Perú de 1993 constituye la consagración jurídica de todo programa jurídico y es la pieza fundamental en el establecimiento del ordenamiento jurídico de la Nación. Siendo esto así para iniciar la siguiente investigación hemos iniciado con el conocimiento de la Carta Magna, que nos asegura la estabilidad, racionalización y limitación al poder de la autoridad, expresándola didácticamente para una lectura ágil y versátil del propio texto, cuyo objetivo final es entender claramente lo que es la autonomía en el sistema universitario.

What the author pretends in this work is to explain some reflections about the Basics of Law in the Administrative Career. Previously, writes a constitutional motivation. Also, examine the text of Legislative Decree No. 276, Basics of Law in the Administrative Career and public sector remunerations. Finally shows the necessary consequences of the normative analysis that is mentioned. ; Lo que pretende el autor mediante este trabajo es exponer algunas reflexiones sobre la Ley de Bases de la Carrera Administrativa. Previamente, escribe una motivación constitucional. Asimismo, examinar el texto del Decreto Legislativo N°276, Ley de Bases de la Carrera Administrativa y de remuneraciones del sector público. Por último señala las consecuencias necesarias del análisis normativo acotado.

El Silencio Administrativo, tiene su origen en Francia, e insurge como Silencio Administrativo Negativo, y con esta orientación, también se incorpora originalmente en nuestro Ordenamiento Procedimental Administrativo: D.S 006-61-SG, Reglamento de Normas Generales de Procedimientos Administrativos, del 11 de noviembre del 67, norma actualmente derogada por la Ley Nº27444: Ley de Procedimiento Administrativo General. En resumen, el Silencio Administrativo se utiliza para combatir la inoperatividad e ineficiencia de la Administración Pública, frente a las peticiones y/o recursos que presentan los administrados y en esta orientación, la Ley Nº29060 modificada por el D. Leg Nº1029, prioriza el Silencio Administrativo Positivo, mediante la creación de nuevos órganos, incrementando atribuciones a otros, para conseguir la aplicabilidad y eficiencia del Silencio Administrativo Positivo, con la finalidad de dinamizar la economía nacional. ; Administrative Silence, originated in France, and swells as Administrative Silence Negative, and with this approach, is also incorporated in our legislation originally Administrative Procedural: D.S.-SG006-67, General Rules of Administrative Procedure Rules, the November 11,67, currently standard repealed by Act.
